Terms of Participation

By entering and participating in the Wanaka Hike & Fly  (‘Event’), you (‘You’ or ‘Participant’) agree to be bound by these Terms of Participation (‘Terms’), by the rulebook which sets out the rules of the Event (“Rulebook”) and represent that you satisfy all of the eligibility requirements below.

2.1

In order to register for the Event, you will be required to take the following steps:

Go to the Website and complete the registration form. 

2.1.2

Agree to these Terms of Participation and accept the Rulebook

2.1.3

Upon completion of this process you will receive a technical e-mail confirming the receipt of your registration and containing your registration data. 

2.1.4

After the Race Committee approve your application, you will receive second email with further details.

2.1.5

To confirm your spot, pay the race fee (200NZD) via method indicated in the email you received.

2.2

The following personal data might be published on the start lists and the results on the Website and other media: first name, last name, date of birth, profession, nationality, picture, name of Safety Assistant. The Organizer also reserves the right to publish answered questions as well as named sponsors of the Athlete from the registration form. 

2.3

The contact details you provide with your registration will be used to notify you of any updates regarding the Event. Please make sure they are accurate. 

2.4

In case a participant does not show up in time for on-site check-in at the Event, he/she will have forfeited the right to participate and will have no right to claim a refund. No exceptions in this regard will be considered whatsoever. 

2.5

Please note that if you should decide not to participate in the Event after January 1, 2021, no refunds will be issued; it is also not possible to transfer the right to participate to the Event to someone else.

In case of very bad meteorological conditions, Race Committee can postpone the Event to one week later. In this case the Race Comittee will annonce the decision no later than March 3, 2021.3.1

In case of very bad meteorological conditions or COVID restrictions, Race Committee can postpone the Event until one week later or until the next available weekend. In this case the Race Comittee will annonce the decision no later than March 3, 2021.

5.2

If in the Organizer’s opinion the Event is compromised by any event beyond the Organizer’s control, the Organizer reserves the right to modify, terminate, amend or extend the Event to the extent permitted by law, and without affecting Your statutory rights, without responsibility and liability for any amount or kind of loss or damage that may result to You or any third party (whether direct or indirect), which will be visible in our Terms on the Website. 

5.3

At any time during the Event, Organizer reserves the right to disqualify and remove any participant for any failure to observe these Terms or the Rulebook or where applicable any other kind of illegal or inappropriate behaviour, including but not limited to: his/her behaviour at the Event or any Event-related activities at any point is disruptive, may or does cause damage to person, property or the reputation of the Organizer; providing false information on the entry forms; for unsportsmanlike conduct; and for medical or safety reasons. In the event that a winning participant is disqualified, the award will be forfeited and/or may be donated or awarded to an alternate winner. No refund will be granted to any disqualified participant for any reason. 

5.4

An Event may be cancelled or changed for any reason, including, without limitation, severe weather or other factors that threaten the safety of participants, staff, or volunteers. In case of any cancellation of the Event for a reason outside the Organizer’s sphere of influence, be it force majeure, government orders, or circumstance under which Organizer cannot with reasonable means guarantee Participants’ safety, no refund whatsoever will be granted. 

6.2

The Organizer, its sponsors, partners, affiliates and service providers will be entitled to capture and use audio recordings, video recordings and photographs from the Event and to use Your name, image, voice, appearance, performance and biographical material for any purpose in all media, forever, subject to limitations pursuant to local statutory law. By accepting the present Terms, You grant the Organizer the right to use such material. 

6.2

The Organizer, its sponsors, partners, affiliates and service providers will be enabled to use, broadcast, screen, display, reproduce and/or make available to the public the material in any and all media. The Organizer, its sponsors, partners, affiliates and service providers will – without need of further approval – be entitled to make any alterations, intermissions, cuts or other modifications in and to the material and to use such altered material without restrictions.

7.1

The Organizer, its sponsors, partners, affiliates and service providers will not in any circumstances be responsible or liable to compensate or accept any liability for any loss, damage, personal injury or death occurring as a result of participation in the Event, as well as taking up the prize(s). Unless such loss arises from the Organizer’s  failure to respect its contractual and legal obligations, in which case the Organizer, its sponsors, partners, affiliates and service providers still limit their liability for the abovementioned situations to the extent allowed by applicable law. Your statutory rights are not affected. 

7.2

The Organizer, its sponsors, partners, affiliates and service providers shall not be liable for: late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible registrations; telephone, electronic, hardware, or software program, network, internet, or computer malfunctions, failures, delays or difficulties; errors in transmission; prize notification deliveries attempted but not received; any loss suffered by anyone who enters or attempts to enter and/or participate in the Event, whether the entry is lost, not submitted, wrongly processed or does not win. 

7.3

The Organizer, its sponsors, partners, affiliates and service providers are not responsible if You are unable to participate in the Event for any reason. 

7.4

The Organizer, its sponsors, partners, affiliates and service providers, are not liable if You injure Yourself while performing actions with regard to this Event. You represent that You do not have any condition and are not affected by any circumstances that would prevent You from safely participating in the Event or would pose a present risk to others in Your doing so. You also agree that You are not otherwise prohibited from participating in the Event for any reason. 

7.5

You grant to the (medical) staff of the Event and its designees permission to administer or arrange for any medical assistance that they deem necessary or appropriate as a result of your participation, including without limitation, arranging transportation to a hospital or other medical facility. 

7.6

You have to follow the instructions by the Organizer and its staff members. In case of noncompliance disturbing the proper course of the Event or jeopardizing the security of the other participants, the Organizer is authorized to ban and/or disqualify the person concerned from the Event at any time. Members of the medical services in charge of the competition who are entitled to prohibit a participant from taking part or continuing participating in the Event in case medical symptoms suggest an impossibility to further participate in the race without endangering the participant’s health. 

7.7

You understand that your participation involves a degree of risk and you willingly assume all risks associated with such participation, including, but not limited to, falls; contact with other participants, spectators or others, or vehicular or other traffic; the effects of the weather, including heat and/or humidity, wind, dangers associated with running or exercising in the dark, cold temperature, and wet or icy surfaces; falling tree branches or other overhead objects; traffic; and other conditions of the course, all such risks being known and appreciated by you. 

7.8

You confirm that neither the Organizer, its sponsors, partners, affiliates and service providers, or Red Bull nor any of its related companies, or cooperation partners is to take responsibility in any way if you get injured. You are in possession of a valid personal liability insurance and personal accident / medical insurance that cover your participation. If You cause damage arising out of, connected with, or as a result of your participation in the Event, You will be fully responsible.

7.9

Your participation may at any time be refused by the Organizer or its staff if they have reasonable doubt regarding your individual safety in participating in the Event.

8.1

In the event of any conflict between these Terms and the Rulebook, the Rulebook shall prevail. 

8.2

These Terms shall be governed by New Zealand Law, and the parties submit to the non-exclusive jurisdiction of the courts competent for the address of the Organizer. 

8.3

If any provision of the Terms shall be held to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions of the Terms shall not in any way be affected or impaired.
